APPLICABLE FROM 1 JANUARY 2022

ARTICLE 1 - GENERAL PROVISIONS RELATING TO THESE GENERAL TERMS AND CONDITIONS OF SALE 

1.1 These general terms and conditions of sale (hereinafter the "GTC") are applicable to and shall govern all online sales of products of the brand La Tour d'Argent, a simplified joint stock company with a capital of 4,573.471, whose registered office is located at 15-17, quai de la Tournelle marketed by the company BURDEL, a limited liability company with a capital of 5,000 euros, whose registered office is located at 15, quai de la Tournelle 75005 Paris, registered with the Paris Trade and Companies Register under the number 817 460 025, intra-community VAT FR91817460025, on the website accessible at epicerie.tourdargent.com (hereinafter the "Site"), which is published by Burdel and is free to access. 

1.2 The GTC apply, without restriction or reserve and by right, to any online sale on the Site (hereinafter the "Order") of La Tour d'Argent brand products (hereinafter the "Products") to buyers with the status of consumers, i.e. non-commercial natural persons of legal age purchasing for their personal nonprofessional needs, as well as legal persons for their needs other than those relating to their professional activities (hereinafter the "Customer(s)").

The GTC are the only ones applicable and, together with the Order, constitute the contractual documents binding on the parties, to the exclusion of all other documents, prospectuses, catalogues or photographs of the products, which are only indicative, or any other contradictory document or general purchase condition of the Customer. 

1.3 The GTC are accessible at any time on the Website where they can be consulted directly. Burdel reserves the right to modify its GTC at any time and without notice. Changes to the GTC are enforceable against Clients as of their posting on the Site and cannot be applied to transactions concluded previously; the version applicable to the Order is the one in force on the Site at the date of its validation. 

1.4 The implementation and finalisation of the Order procedure, as described in Article 6 below, implies that the Customer consults and expressly accepts the General Terms and Conditions of Use, the personal data processing policy and the General Terms and Conditions of Business, which can be saved and/or printed out, by clicking on the confirmation box provided for this purpose (reproducing the sentence "I certify that I have read and accepted the General Terms and Conditions of Business, the personal data processing policy practised by Burdel and the General Terms and Conditions of Business of the website www.epicerie.tourdargent.com de la Tour d'Argent"). This validation implies the Customer's acceptance without restriction or reservation of the entire GTC, which Burdel is responsible for keeping and reproducing in accordance with Article 1127-2 of the Civil Code. 

1.5 The Customer acknowledges and warrants that he/she has the capacity and age required (majority) to contract and/or place an Order on the Site.

If a condition of sale were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies are based in France.

ARTICLE 2 - PRODUCT OFFER 

2.1 The online sales of Products on the Site are exclusively reserved for Customers who are natural persons of legal age, who are not traders and who are buying for their personal, non-professional needs, as well as legal persons for their needs other than those relating to their professional activities.

Any resale of Products is strictly prohibited. 

2.2 The online sale of Products on the Website is exclusively reserved for Customers established in Germany. Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom and for delivery of the Products in these geographical areas. 

ARTICLE 3 - PRODUCTS 

3.1 The Products covered by these GTC are those which appear on the Seller's Site and which are indicated as being sold and shipped by the Seller. The Products are the subject of a brief, non-exhaustive description, indicating their essential characteristics with the greatest possible accuracy, their name and their price. If errors or omissions have occurred in this presentation, the seller cannot be held responsible.

The photographs illustrating the Products do not constitute a contractual document and are merely indicative of the general presentation of the Product. Burdel cannot be held responsible for any errors.

The Products comply with the regulations in force in France relating to the safety and health of persons, fair trading and consumer protection at the time they are placed on the market.

3.2 The Products are offered for sale and delivered only during the period in which they are presented online and within the limits of available stocks. Indications of Product availability may contain errors or not be up to date, particularly in the event of simultaneous orders for the same Product by different Customers. If the Product ordered is unavailable, Burdel will inform the Client as soon as possible by telephone or email and may offer (i) a longer delivery time, (ii) a Product of equivalent quality and price or (iii) to cancel the Order and refund the price paid for it. If the Client does not agree or if the Order is cancelled, Burdel will refund the amounts paid within 30 days by bank transfer. Apart from the reimbursement of the price of the unavailable Product, the seller is not liable to pay any compensation for unavailability or cancellation.

ARTICLE 4 - PRICES 

4.1 The sale prices are indicated, for each of the Products listed on the Site, in euros, including all taxes, but excluding delivery and transport costs, which are mentioned before the Order is confirmed and invoiced in addition. The total amount due by the Customer, including all costs and applicable VAT, is indicated on the Order confirmation page, subject to availability at that time. Any change in the applicable VAT rate will automatically be reflected in the price of the products in the online shop. Payment of the full price must be made at the time of the Order. At no time may the sums paid be considered as a deposit or advance payment.

The selling price of the Product is the one in force on the day of the Order.

Burdel reserves the right to change its prices at any time, while guaranteeing the Client the price in force on the day of the Order. 

4.2 In the event of a price promotion, Burdel undertakes to apply the promotional price to any Order placed during the period in which the promotion is advertised.

If one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change could be reflected in the selling price of the Products. 

4.3 Any additional transport, delivery or postage costs, of which the Customer may have been aware prior to placing the Order, shall be determined after the validation of the product basket and the indication of the desired delivery method for the Order.

ARTICLE 5 - CLIENT ACCOUNT - GUEST ACCOUNT 

5.1 In order to place an Order, any Customer may first complete and return a Customer Account application form (hereinafter the "Form") on the Web Site. The Form implies the communication of all the data and information requested during the operation, and in particular :

Postal address (for billing and delivery) 

Selected password 

This information required in the Form is necessary to finalise the opening of the Customer Account and to deliver the Products.

5.2 Validation and submission of the form to Burdel requires the Client to first consult and accept the General Conditions of Use of the Website, Burdel's personal data processing policy and the GTC, which can be saved and/or printed, by clicking on the confirmation box provided for this purpose (reproducing the sentence "I certify that I have read and accepted the General Terms and Conditions of Business, Burdel's personal data processing policy and the General Terms and Conditions of Use of the website www.epicerie.tourdargent.com"), and then to validate the form.

No application to open a Client Account at Burdel can be finalised unless the General Conditions of Use of the Website and the GTC are accepted by the Client beforehand. This validation implies the full acceptance of the Terms and Conditions and the GTC without restriction or reservation. 

5.3 The submission of the Form by a Client on the Site creates a Client Account on the Site with the information provided in the Form. Burdel confirms receipt of the Form by sending an email to the email address provided in the Form.

5.4 The Client is solely responsible for all data he provides to Burdel and guarantees that the information is true, accurate and complete and does not infringe any third-party rights or violate any applicable laws or regulations. The Client is solely responsible for any loss and/or damage resulting from incomplete or misleading data and/or information transmitted to Burdel or communicated via the website. 

5.5 Access to the Customer Account is possible using the login and password from any computer or laptop.

The Customer is solely responsible for accessing his Customer Account, for the use and confidentiality of his identifiers, and for any transmission of data relating to the Customer Account, particularly if the Customer takes the risk of pre-recording his identifiers (login and password) on his computer, thereby enabling automatic connection to the Customer Account. In this respect, the Customer shall bear the consequences that may result from any fraudulent use by a third party. 

The Customer undertakes not to allow third parties to access the Site via his Customer Account and must respect the rules of confidentiality of his identifiers which are strictly personal and confidential. 

The Client must inform Burdel without delay by email to "epicerie@tourdargent.com" if he/she notices any unauthorised use (suspected or proven) of his/her Client Account, a security breach or violation (suspected or proven) linked in particular to the voluntary or involuntary communication, loss or misappropriation of a login or password, so that Burdel can take all appropriate measures without delay to remedy the security breach and assign a new login or password. 

5.6 These connection identifiers shall be requested at each connection, shall constitute proof of the Customer's identity, and shall be binding on the Customer in respect of any Order placed via the Customer Account.

5.7 Subject to informing the Client by email, Burdel may close any Client Account, without notice or compensation, in the event of :

illicit use, attempted illicit use or even complicity in illicit use of the Site and/or the Customer Account, in particular in the event of use in violation of any law or regulation in force or infringing any third party right, counterfeiting, etc. ;

use of the Site and/or the Customer Account in violation of any of the provisions of the General Terms and Conditions of Use of the Site or the GTC; 

termination of the operation of the Site by Burdel for any reason; 

inactivity of the Client Account for an uninterrupted period of two years. 

5.8 The Customer may terminate his Customer Account at any time, subject to compliance with all the provisions of the applicable GTC, by sending a request to this effect by e-mail to the address "epicerie@tourdargent.com". All data related to this Client Account will then be deleted. Burdel will only keep the Client's personal data for as long as there are outstanding items (unpaid invoices, disputes, litigation, etc.). 

5.9 The Client may also place an Order as a guest, by filling in the form provided for this purpose when completing the Order. Validating and sending this form to Burdel requires the Client to first consult and accept the General Terms and Conditions of Use of the Site, the personal data processing policy applied by Burdel, and the GTC, which can be saved and/or printed, by clicking on the confirmation box provided for this purpose (reproducing the sentence "I certify that I have read and accepted the General Terms and Conditions of Sale, the personal data processing policy applied by Burdel and the General Terms and Conditions of Use of the site www.epicerie.tourdargent.com"), and then validates the said form (hereinafter "Guest Account").

ARTICLE 6 - ORDERING 

6.1 In accordance with the provisions of Article 1126 of the Civil Code, the Client expressly accepts the use of electronic mail for the communication of all information necessary or requested for the conclusion of the Order or that which is sent during its execution.

6.2 The Customer may place an Order on the Site from the online catalogue, by accessing their Customer Account, using their login details, which allows them to use the information provided during the previous order, or by using the Guest Account form.

6.3 The Customer fills his virtual basket on the Site, indicating the Products selected and the quantities desired, then clicks on the "Order" button. The Customer is invited to indicate their choice of delivery address, payment method and delivery method. The Order is summarised, including the Products entered and the total price, including delivery costs. 

Before validating an Order, it is up to the Customer to check the accuracy of the Order and all of its elements, in particular the total price and, if necessary, to identify and correct the errors or possibly modify the Order. The Client may then definitively validate his/her Order, which implies full and unconditional acceptance of the General Terms and Conditions of Use of the Site, the personal data processing policy applied by Burdel, and the General Terms and Conditions of Sale (by clicking on the confirmation box provided for this purpose reproducing the sentence "I certify that I have read and accepted the General Terms and Conditions of Sale, the personal data processing policy applied by Burdel and the General Terms and Conditions of Use of the site www.epicerie.tourdargent.com"). No order will be accepted if the GTC are not accepted by the Client beforehand.

6.4 In order to validate the Order, the Customer must pay the total price in full. Any payment made by credit card shall only be considered effective once the payment centres have given their approval. In the event of refusal by the aforementioned centres, the Order shall be automatically cancelled, without any compensation being payable by the Customer. The Customer shall be informed by the payment centre by means of a message on the screen. 

6.5 As soon as the full price has been paid, the Order shall be automatically recorded and shall become firm and definitive. The acceptance of the Order shall be confirmed by sending an e-mail to the Customer at the e-mail address indicated in the Order or the Customer Account, summarising the Products ordered, the delivery address, the chosen method of payment and an Order number. The information provided by the Client at the time of placing the Order shall be binding. In the event that the Client makes a mistake in the details of the Product(s) or the place of delivery, in particular: surname, first name, address, telephone number, e-mail address, door code, floor, resulting in the loss of the Product(s), the Client shall remain liable for the payment of the lost Product(s) and no compensation or refund shall be made. 

6.6 The Site's automatic recording systems are proof of the nature, content and date of the Client's Order, of the confirmation of receipt of the Order by Burdel, as well as of any electronic mail exchanged between Burdel and the Client. The information relating to all operations carried out on the Site will be stored and archived, and may be used as proof in the event of a dispute.

6.7 Any change to the Order by the Client after validation of the Order is subject to acceptance by Burdel. 

6.8 Burdel reserves the right to refuse any Order that appears to be contentious, fraudulent or for legitimate reasons, and more particularly if the quantities of Products ordered are abnormally high for Clients with the status of consumers and any Order by a Client with whom there is a dispute of any kind, past or ongoing, and in particular a dispute relating to the payment of a previous Order. Burdel reserves the right to ask the Client, prior to processing the Order, for any proof of identity or domicile. In certain cases, in particular non-payment, incorrect address or other problem on the Client's account, the seller reserves the right to block the Client's order until the problem is resolved. 

6.9 Dear American customers, please note that a Champagne Certificate of 10€ is mandatory when purchasing Champagne.

ARTICLE 7 - PAYMENT 

7.1 The price is payable in full upon validation of the Order by the Customer. No discount or late payment penalty shall be applied. Payment shall be made immediately upon placing the Order, by credit card only. Payment by credit card automatically redirects the Customer to the Société Générale secure site, which guarantees the confidentiality of credit card numbers. The Customer's bank account is debited at the time the Order is validated.

In case of a distance payment or by bank transfer, the online shop Epicerie Tour d'Argent reserves the right to tacitly set a delay to pay beyond which if not met, the order will be cancelled and the products will be reput on sale.

7.2 An invoice will be included in the package unless the delivery address is different from the billing address. In the latter case, the invoice will be sent to the billing address and by e-mail to the address specified in the Customer Account or when placing the Order. 

ARTICLE 8 - DELIVERY OR COLLECTION 

8.1 The Order shall not be dispatched without full payment of the Products ordered and the delivery charges, as calculated on the Order summary.

8.2 The Products are delivered to the address indicated by the Client at the time of the Order or are available for collection in the shop at "La Petite Epicerie de la Tour", 13 quai de la Tournelle 75005 Paris, if the Client has chosen this method of collection in the shop.

In the event of delivery, Burdel undertakes, in accordance with the delivery deadline indicated on the Site for each Product, to deliver the Products after receipt of the Order within :

10 working days in metropolitan France.

20 working days abroad or in the French overseas territories. 

If the Product ordered is not delivered on the date or at the end of the period stated in the Order, the Client may cancel the Order by registered letter with acknowledgement of receipt thirty (30) days after unsuccessfully requesting Burdel to fulfil its delivery obligation within a reasonable additional period. In this case, Burdel will reimburse all sums paid by the Client within fourteen (14) days of receiving the cancellation, to the exclusion of any other compensation.

In the event of click & collect, the Client must collect the Product Ordered within fifteen (15) days of its availability, which is notified to the Client by email. In the absence of collection within the period indicated, Burdel may, after a reminder by email that has remained without effect for seven (7) days, automatically cancel the Order and retain the price paid as compensation. 

8.3 When the Product is delivered to the address indicated on the Order by a carrier, it is the Client's responsibility to check the condition of the delivered Product in the presence of the delivery person and, in the event of damage or missing items, to express reservations on the delivery note or the transport receipt, and possibly to refuse the Product and immediately notify Burdel by post to Burdel, 15 quai de la Tournelle, 75005 Paris or by e-mail to epicerie@tourdargent.com. 

In the event of delivery by a carrier requiring an appointment with the Client, the carrier will contact the Client as soon as possible to arrange a delivery appointment with the Client, no later than 30 days from the date of the Order validation. Burdel cannot be held responsible for any delay in delivery due exclusively to the Client's unavailability after several proposed appointments by the carrier. 

8.4 The risk of loss of or damage to the Products passes to the Client at the time the Client or a third party designated by the Client, other than the carrier offered by Burdel, takes physical possession of the Product.

The Customer is required to check the condition and contents of the package upon receipt and to verify that the Product delivered complies in all respects with the Order. If the Product does not comply with the Order or in the event of an apparent defect, shortage or damage, the Client must send a written complaint to Burdel within seventy-two (72) hours of receipt, to the address La Tour d'Argent, 15 quai de la Tournelle, 75005 Paris or by e-mail to epicerie@tourdargent.com, giving all the information on the nature and extent of the damage suffered by the Product. After this period, the Products delivered will be deemed to be in conformity and any claim not made in accordance with the rules defined above and within the time limits set shall not be taken into account and shall release the seller from any liability towards the Customer. 

Upon receipt of the complaint, the seller will assign an exchange number for the product(s) concerned and will communicate it to the buyer by e-mail. The exchange of a product can only take place after the exchange number has been allocated.

In the event of a delivery error or exchange, any product to be exchanged or reimbursed must be returned to the seller as a whole and in its original packaging, by Colissimo Recommandé, to the following address: Burdel, 15 quai de la Tournelle, 75005 Paris. The return costs are at the seller's expense. 

ARTICLE 9 - LEGAL GUARANTEES 

9.1 The Products supplied by Burdel benefit from the legal guarantee of conformity provided for in Articles L. 217-4 to L. 217-14 of the Consumer Code or the guarantee of hidden defects provided for in Articles 1641 to 1649 of the Civil Code. 

9.2 In accordance with Articles L. 217-1 et seq. of the Consumer Code, Burdel is obliged to deliver a Product that complies with the Order and is liable for any lack of conformity existing at the time of delivery. Burdel is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation if the latter was made responsible for by the Order or was carried out under its responsibility. In order to be in conformity with the Order, the Product must be fit for the use usually expected of a similar good. 

Within the framework of the legal guarantee of conformity, the Customer :

has a period of two years from the date of delivery of the goods to act; 

may choose between repairing or replacing the goods, subject to the cost conditions set out in Article L. 217-9 of the Consumer Code. 

Defects of conformity that appear within twenty-four months of delivery of the Product are presumed to have existed at the time of delivery, unless proven otherwise.

Non-conforming Products must be returned or brought back to the shop in the state in which the Customer received them with all the elements (accessories, instructions, etc.) in packaging that allows them to be transported under good conditions. The shipping costs will be reimbursed to the Client on the basis of the invoiced rate and the return costs will be reimbursed upon presentation of the receipts. Burdel may not proceed according to the Client's choice if this choice entails a cost that is clearly disproportionate to the other method, taking into account the value of the goods or the importance of the defect.

9.3 The Client may decide to invoke the guarantee against hidden defects of the item sold in accordance with Article 1641 et seq. of the Civil Code. Burdel is liable for hidden defects in the Product that make it unsuitable for its intended use, or that reduce this use to such an extent that the Client would not have purchased it, or would have paid a lower price for it, if he had known about them. Burdel is not liable for apparent defects of which the Client could have convinced himself. The defect must have occurred prior to the sale and must render the products unfit for the intended purpose. 

The Customer has the choice : 

return the thing and have the price returned; 

keep the thing and get part of the price back. 

The time limit for action is 2 years from the discovery of the defect. 

ARTICLE 10 - LIABILITY 

10.1 Burdel cannot be held liable in the event of non-performance or poor performance of the Order due to the fault of the Client or the insurmountable and unforeseeable fault of a third party to the Order, or force majeure. In the event of a force majeure event such as war, riot, fire, strikes, supply impossibility, pandemic, transport stoppage that would tend to delay or prevent the execution of supplies constitute a cause for suspension or cancellation of Burdel's obligations, without compensation other than reimbursement of the Order in the event of cancellation, to the benefit of the Client if the event lasts more than five (5) days. The Client will be informed by any appropriate means, so that he can withdraw from his Order by simply responding in writing.

Burdel cannot be held responsible for the Product's non-conformity with the legislation of the Client's country. It is the Client's responsibility to check that the Product is not prohibited for sale in his country. 

10.2 In the event of damage caused by a safety defect in the Product, the Customer shall seek the liability of the manufacturer identifiable from the information on the Product's packaging. 

ARTICLE 11 - RIGHT OF WITHDRAWAL 

11.1 The Client may withdraw from the Order, without having to give any reason or pay any penalties, within fourteen (14) days of receipt of the Product by the Client or a third party, other than the carrier, designated by the Client. To exercise his right of withdrawal, the Client must notify Burdel of his decision to withdraw from the Order by means of an unambiguous statement expressing his wish, and including your identity, address, full contact details, by registered letter with acknowledgement of receipt to Burdel, 15 quai de la Tournelle, 75005 Paris or by email to epicerie@tourdargent.com. In order for the withdrawal period to be respected, it is sufficient for the Client to send his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period. The Customer may use the model withdrawal form reproduced at the bottom of the GTC, but this is not obligatory.

11.2 In the event that the Client withdraws from the Order, Burdel will refund all payments received by the Client, including delivery costs (except for any additional costs arising from the fact that the Client has chosen a delivery method other than the cheaper standard delivery method offered by Burdel) without undue delay and in any event no later than fourteen (14) days from the day of receipt by Burdel of the Client's decision to withdraw from the Order. Burdel will make the refund using the same means of payment that the Client used for the initial transaction, at no additional cost to the Client. However, Burdel may postpone the refund until receipt of the Product(s) covered by the withdrawn Order. 

11.3 It is recalled that the Customer's liability, in the event of withdrawal after use of the goods, is engaged with regard to the depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods. These manipulations are those that a consumer can carry out in a shop, for the goods offered for sale there. 

The Client must return the Product to Burdel - La Tour d'Argent, 15 quai de la Tournelle, 75005 Paris without undue delay and, in any event, no later than fourteen (14) days after the Client has informed Burdel of his decision to withdraw from the Order. This deadline is deemed to have been met if the Client returns the Product before the expiry of the fourteen (14) day period.

In case of withdrawal by the Customer, the Customer shall bear all direct costs of returning the Product.

11.4 In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts including

The supply of goods made to the consumer's specifications or clearly personalised; 

The supply of goods that are likely to deteriorate or expire rapidly; 

The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection; 

The supply of goods which, after delivery and by their nature, are inseparably mixed with other articles; 

The supply of alcoholic beverages whose delivery is delayed beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations in the market beyond the trader's control. 

For further information on the scope, content and instructions for exercising the right of withdrawal, the Client is invited to contact Burdel's customer service as described in article 14 below.

ARTICLE 12 - PROCESSING OF PERSONAL DATA 

The data and information that you provide to Burdel in the Form or when placing the Order include personal data. This data is processed automatically and stored in Burdel's information system and database. The Client expressly accepts Burdel's personal data processing policy, which is accessible on the Website. 

ARTICLE 13 - PROTECTION OF MINORS 

In accordance with the provisions of article L.3342-1 of the Public Health Code, the sale of alcohol to minors under the age of eighteen (18) is strictly prohibited. Any person ordering on the Site therefore undertakes to be of age. Burdel reserves the right to request any proof. 

ARTICLE 14 - CUSTOMER SERVICE 

For any further information, you can contact the Seller either by telephone at +33 1 40 46 71 24 (Tuesday to Saturday from 12pm to 7pm) except on public holidays, or by post to La Petite Epicerie de la Tour - Boutique - 13 quai de la Tournelle - 75005 Paris, or by email at: epicerie@tourdargent.com. 

ARTICLE 15 - MISCELLANEOUS 

15.1 In the event that any provision of the GTC is held to be invalid, illegal or unenforceable by a competent court or authority, or pursuant to any applicable law or regulation, the affected provision shall be deleted without affecting the validity or enforceability of the remaining provisions of the GTC. The parties shall consult and negotiate in good faith in order to try to find ways to implement the purpose of the provision. 

15.2 The failure of either party to exercise any right or to require the other party to perform any obligation under the GTC shall not constitute a waiver of the exercise of such right or the performance of such obligation, nor shall it relieve the defaulting party from the performance of its obligations under the Order in the future. 

ARTICLE 16 - SETTLEMENT OF DISPUTES 

16.1 The GTC and the operations arising from them are subject to French law. The GTC and all contractual information mentioned on the Site are written in French. In the event that they are translated into one or more languages, only the French text shall be deemed authentic in the event of a dispute. 

16.2 The Client is informed that he/she may in any case have recourse to conventional mediation or to any alternative dispute resolution method in the event of a dispute. For any difficulty, Burdel invites the Client to contact it beforehand by email at epicerie@tourdargent.com, or by post at 15, quai de la Tournelle 75005 Paris, or by telephone on +33 1 40 46 71 24 (Tuesday to Saturday from 12pm to 7pm) except for public holidays.

In the event of failure to file a claim with Burdel or in the absence of a response from Burdel within two (2) months, the Client may submit the dispute relating to the Order or the GTC between him and Burdel to a mediator who will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution. To submit a request for mediation, the 

Customer has a complaint form available on the mediator's website: by post to Devigny Médiation, Mrs Emmanuelle Devigny, 11, rue de l'Étang 49220 Thorigne d'Anjou, or by telephone +33 (0)2 41 25 47 58. The parties remain free to accept or refuse recourse to mediation and, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator. 

The Customer may also choose to resolve the dispute using the online dispute resolution platform published by the European Commission at the following address: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR 

16.3 In the absence of an amicable agreement, any claim or dispute arising from the validity, interpretation or execution of the GTC shall be submitted to the competent courts of the place of residence of the defendant or of the place of actual delivery of the goods.
